Terms & Conditions of Use

1) APPLICATION

This Agreement applies to your use of our Site. You—the party entering information (“You”)—are entering into a legally binding Agreement (the “Agreement”) with the company, including our Privacy Policy, which is incorporated by reference.

Direct Solar NRG will not provide your contact information to any unaffiliated third parties.

You agree that submitting information does not establish a relationship. You consent to the information submitted being reviewed by paid advertisers for this advertisement.

You understand and agree that any information received in follow-up communications is general information for which there will be no charge. You further acknowledge that the law for each state may vary, and therefore, You will not rely upon this information as advice. Because each business, home and owner may require different information regarding your state of residence, local estimates may or may not be available.

We may conclude that the information You submit does not meet out criteria for follow-up. We reserve the right, in our sole and absolute discretion, to determine whether Your submissions merits follow-up.

3) RELEASE

YOU HEREBY AGREE TO RELEASE, REMISE AND FOREVER DISCHARGE Direct Solar NRG AND Direct Solar NRG PARTIES AND EACH OF THEIR RESPECTIVE AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, AND ALL OTHER RELATED PERSONS OR ENTITIES FROM ANY AND ALL MANNER OF RIGHTS, CLAIMS, COMPLAINTS, DEMANDS, CAUSES OF ACTION, PROCEEDINGS, LIABILITIES, OBLIGATIONS, LEGAL FEES, COSTS, AND DISBURSEMENTS OF ANY NATURE WHATSOEVER, WHETHER KNOWN OR UNKNOWN, WHICH NOW OR HEREAFTER ARISE FROM, RELATE TO, OR ARE CONNECTED WITH YOUR USE OF THE SERVICE.

4) APPLICABLE LAW

By visiting Direct Solar NRG, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and Direct Solar NRG or its affiliates.

5) DISPUTES

Any dispute relating in any way to your visit to Direct Solar NRG shall be submitted to confidential arbitration in the State of California, except that, to the extent you have in any manner violated or threatened to violate any Direct Solar NRG intellectual property rights, Direct Solar NRG may seek injunctive or other appropriate relief in any state or federal court in the State of California and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
